Italian minimum wage - new law from 21 July 2106

Further to our previous communication, OFAE has now further information on the posting of workers law that entered into force in Italy in July 2016 (please see the attached document). The document explains details of the law including registration obligation, record keeping provisions and potential penalties.
Most importantly, as for road transport it is now confirmed that the law covers all kinds of freight and passenger transport (cabotage, transit, point to point intra EU operations, 3rd country operations). This was also explicitly confirmed with the Italian Permanent Representation to the EU.
However, the Italian authorities recommend awaiting the publication of the implementing decree and further clarifications as consultations between mainly the Labour Ministry and Ministry of Transport are ongoing. This ministerial decree should be published within several weeks and should set further details including on the scope and registration procedure.
OFAE in close cooperation with the IRU who is following the situation continuously, will be publish any new information as soon they are available.
