Posting of drivers - EC Q&A for EU posting rules published and IMI interface

On 02.02.22, the new EU rules (EU 2020/1057) on posting of drivers will become applicable in the 27 Member States. The EU Commission made important progress to this end by fulfilling 2 fundamental tasks:
- Publishing official clarification of the new EU rules on the posting of drivers by a guidance document entitled “Guidance on posting of drivers” (attached in a Word format for your ease of reference and available online here: https://transport.ec.europa.eu/transport-modes/road_en). The guidance is mainly addressed to road transport operators to help them understand how to apply the rules on posting of drivers, and in particular when posting situation starts and when it ends in various transport operation scenarios. This is the first part of the clarifications, which covers only basic scenario in freight transport. The subsequent editions will include clarification of application of the posting rules to passenger transport, road leg of combined transport, transport operations with third countries, etc.

- The Internal Market Interface (IMI) for drivers’ posting declarations for EU road transport operators went live. The Road Transport Posting Declaration portal (RTPD) is now accessible and ready for use. On this new portal, you will find FAQs as well as video tutorials explaining step-by-step how to use the Portal. Both the FAQs and the video tutorials are available in all community languages. Road transport operators who have to comply with the EU provisions of posting of drivers will have to upload posting declarations to the Member State(s) where their drivers will be posted. Through the same portal they can receive requests from and submit documents to the Member State(s) in which their drivers have been posted. For reminder, operators have to create first an EU Login at https://ecas.ec.europa.eu/cas/eim/external/register.cgi and only then enter the IMI portal to create their company account, which would allow them to register their drivers and create posting declarations. We also remind you that whilst it is recommended to already start uploading the company profile with information, posting declarations can only be submitted as from 2 February 2022. As of that date, this portal becomes the only place where EU-registered operators have to submit posting declarations for their drivers to EU Member States replacing all national portals for road transport posting.
