Court of Justice of the EU ruling: regular weekly rest in the vehicle cabin

The Court of Justice of the EU decided today that Regulation (EC) No 561/2006 [Article 8.8] must be understood as preventing drivers from taking their regular weekly rest period in their vehicles.
The reduced weekly rest periods and daily rest periods may still be taken in the vehicles, subject to the conditions of Regulation (EC) No 561/2006 [suitable sleeping facilities and the vehicle is stationary].
The Court of Justice of the EU also confirmed that it is for Member States to determine penalties for the purpose of enforcing this provision.
That decision was anticipated. In 2018, while intensifying its advocacy activities regarding the EU Mobility Package, IRU, together with IRU Members, will partner in an EU-funded study that will lead to the establishment of a safe and secure truck parking network in the EU.
